ನವದೆಹಲಿ, ಮೇ 11: ಶೃಂಗೇರಿ ವಿಧಾನಸಭಾ ಕ್ಷೇತ್ರದ ಅಂಚೆ ಮತಗಳ ಮರು ಎಣಿಕೆ ವಿವಾದ ಇಡೀ ದೇಶದ ಗಮನ ಸೆಳೆದಿದೆ. ಈ ನಡುವೆ ಶೃಂಗೇರಿ ಕ್ಷೇತ್ರಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ, ಕರ್ನಾಟಕ ಹೈಕೋರ್ಟ್ ನೀಡಿದ್ದ ತೀರ್ಪಿಗೆ ಮೇ 11 ರಂದು ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ತಡೆಯಾಜ್ಞೆ ನೀಡಿದೆ. ಯಥಾಸ್ಥಿತಿ ಕಾಯ್ದುಕೊಳ್ಳಲು ಆದೇಶಿಸಿದೆ. ಇದರಿಂದ ಶೃಂಗೇರಿ ಕ್ಷೇತ್ರದ ಶಾಸಕರಾಗಿ ಕಾಂಗ್ರೆಸ್ ನ ಟಿ ಡಿ ರಾಜೇಗೌಡ ಅವರು ಮತ್ತೆ ಮುಂದುವರೆಯುವಂತಾಗಿದೆ.
ಹೈಕೋರ್ಟ್ ಸೂಚನೆ ಮೇರೆಗೆ ಇತ್ತೀಚೆಗೆ ಶೃಂಗೇರಿ ಕ್ಷೇತ್ರದ ಚುನಾವಣೆಯ ಅಂಚೆ ಮತಗಳ ಮರು ಎಣಿಕೆ ನಡೆದಿತ್ತು. ಸದರಿ ಎಣಿಕೆಯಲ್ಲಿ ಬಿಜೆಪಿ ಅಭ್ಯರ್ಥಿ ಡಿ ಎನ್ ಜೀವರಾಜ್ ಗೆಲುವು ಸಾಧಿಸಿದ್ದರು. ಇದರಿಂದ ಡಿ ಎನ್ ಜೀವರಾಜ್ ಅವರನ್ನು ಶಾಸಕರನ್ನಾಗಿ ಚುನಾವಣಾ ಆಯೋಗ ಘೋಷಿಸಿತ್ತು.
ಮಾಜಿ ಶಾಸಕ ಟಿ ಡಿ ರಾಜೇಗೌಡ ಅವರು ಅಂಚೆ ಮತಗಳ ಮರು ಎಣಿಕೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಹೈಕೋರ್ಟ್ ಆದೇಶ ಪ್ರಶ್ನಿಸಿ, ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಗೆ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಿದ್ದರು. ನ್ಯಾಯಮೂರ್ತಿಗಳಾದ ಸಂಜಯ್ ಕುಮಾರ್ ಮತ್ತು ಕೆ ವಿನೋದ್ ಚಂದ್ರನ್ ಅವರಿದ್ದ ಪೀಠವು ಸದರಿ ಅರ್ಜಿಯ ತುರ್ತು ವಿಚಾರಣೆ ನಡೆಸಿತು. ಹೈಕೋರ್ಟ್ ನೀಡಿದ್ದ ಆದೇಶಕ್ಕೆ ತಡೆಯಾಜ್ಞೆ ನೀಡಿದೆ.
ಪ್ರಕರಣದ ಹಿನ್ನೆಲೆ : 2023 ರ ವಿಧಾನಸಭೆ ಸಾರ್ವತ್ರಿಕ ಚುನಾವಣೆಯಲ್ಲಿ ಕಾಂಗ್ರೆಸ್ ಅಭ್ಯರ್ಥಿ ರಾಜೇಗೌಡ ಅವರು ಡಿ ಎನ್ ಜೀವರಾಜ್ ಅವರ ವಿರುದ್ಧ 201 ಮತಗಳ ಅಂತರದಿಂದ ಜಯ ಗಳಿಸಿದ್ದರು.
ಬಿಜೆಪಿ ಅಭ್ಯರ್ಥಿ ಜೀವರಾಜ್ ಅವರು ಚುನಾವಣಾ ಅಕ್ರಮಗಳ ಆರೋಪ ಹೊರಿಸಿ ಅಂಚೆ ಮತಗಳ ಮರು ಎಣಿಕೆಗೆ ಕೋರಿ ಹೈಕೋರ್ಟ್ನಲ್ಲಿಅರ್ಜಿ ಸಲ್ಲಿಸಿದ್ದರು. ಅಂಚೆ ಮತಗಳ ಮರು ಎಣಿಕೆ ಮಾಡುವಂತೆ ಹೈಕೋರ್ಟ್ ತೀರ್ಪು ನೀಡಿತ್ತು.
ಅದರಂತೆ ಮೇ 2 ರಂದು ಅಂಚೆ ಮತಗಳ ಮರು ಎಣಿಕೆ ನಡೆದಿತ್ತು. ಅದರಲ್ಲಿ ರಾಜೇಗೌಡರಿಗೆ 255 ಮತಗಳು ಕಡಿಮೆಯಾಗಿದ್ದವು. ಜೀವರಾಜ್ ಅವರನ್ನು ವಿಜೇತ ಅಭ್ಯರ್ಥಿ ಎಂದು ಚುನಾವಣಾ ಆಯೋಗ ಘೋಷಿಸಿತ್ತು. ಇದರಿಂದ ಟಿ ಡಿ ರಾಜೇಗೌಡ ಅವರು ಮಾಜಿ ಶಾಸಕರಾಗಿದ್ದರು.
Supreme Court’s Important Order: T. D. Rajegowda Back as MLA for Sringeri Constituency!
New Delhi, May 11: The controversy over the recounting of postal ballots in the Sringeri Assembly constituency has drawn national attention. On May 11, the Supreme Court issued a stay order on the Karnataka High Court’s ruling regarding this matter. The Court directed that the status quo be maintained. As a result, Congress leader T. D. Rajegowda will continue as the MLA for Sringeri.
Following the High Court’s instructions, postal ballots in the Sringeri constituency election were recently recounted. In that recount, BJP candidate D. N. Jeevaraj was declared the winner. Consequently, the Election Commission had announced Jeevaraj as the MLA.
Former MLA T. D. Rajegowda challenged the High Court’s order on the recount and filed an appeal in the Supreme Court. The bench comprising Justices Sanjay Kumar and K. Vinod Chandran heard the matter urgently and stayed the High Court’s order.
Background of the case: In the 2023 Karnataka Assembly elections, Congress candidate Rajegowda had defeated BJP’s D. N. Jeevaraj by a margin of 201 votes. Jeevaraj alleged electoral irregularities and petitioned the High Court for a recount of postal ballots. The High Court ordered the recount, which was carried out on May 2. In that recount, Rajegowda lost 255 votes, and Jeevaraj was declared the winner by the Election Commission. This had made Rajegowda a former MLA.
Now, with the Supreme Court’s stay order, Rajegowda continues as the MLA for Sringeri until further proceedings.
